Netlist Files New ITC Action Against Micron Technology Over HBM Patents for AI Computing

Netlist has initiated new legal proceedings before the United States International Trade Commission (ITC). The company is seeking exclusion and cease and desist orders against Micron Technology, Inc. and downstream customers Nvidia, Broadcom, and Google, referred to collectively as the Respondents.

The ITC investigation is based on alleged infringement of Netlist’s High Bandwidth Memory (HBM) patents. These patents cover technologies used in advanced AI computing.

In the ITC complaint against Micron, Netlist requests that the ITC investigate the Respondents for infringement of U.S. Patent Nos. 12,308,087 and 12,646,537. Netlist alleges that these patents cover at least Micron’s HBM3E, HBM4, and HBM4E products. Netlist is represented by Sterne Kessler Goldstein & Fox and Irell & Manella.

Separately, Netlist filed another ITC complaint against Micron on August 11, 2026. That complaint also named Super Micro Computer, Hewlett Packard Enterprise, and Lenovo. It alleged that Micron’s DDR5 RDIMMs and/or MRDIMMs infringe four Netlist patents. The ITC instituted that case as Investigation 337-TA-1523 on September 23, 2026.
